Medical Fee Dispute Resolution (MFDR)
After you have appealed your disputes to the carrier in the form of requests for reconsideration without a satisfactory outcome, your next step is to appeal your unpaid workers' compensation bills to the Division of Workers' Compensation (DWC).
Benefit Review Conference (BRC)
As a provider of health care to injured workers in Texas you have the right to be included during an injured worker's dispute and you may even initiate this level of proceeding when the injured worker does not.
A BRC officer is NOT an attorney and the BRC is informal. Shepler's MD Resolutions has successfully secured payment for providers through BRC on many occasions. We have even secured payments from insurance carriers for services in which the claim was not compensable. Our thorough knowledge of the law and the rules related to Texas Workers' Compensation is invaluable to our success.

Contested Case Hearings (CCH)
A Contested Case Hearing is a formal administrative hearing before a hearing officer, who is a licensed attorney in the State of Texas. At the level of a CCH you must be familiar not only with the rules and laws of The Texas Workers' Compensation Act but also the processes and procedures related to the hearing.

Arbitration
You may choose to forego a CCH in favor of Arbitration. Arbitration in this setting is heard by a DWC appointed neutral arbitrator. The arbitrator's decision is final and binding. An Appeal of Arbitration WILL require the services of a licensed attorney.

Appeals Panel Decisions
Following a CCH a carrier may appeal the CCH decision to the Appeals Panel. While there is no requirement to present to the Appeals Panel a reversal of decision or a Reman to CCH may occur.
Upon a reversal you have the right to appeal to a court of competent jurisdiction. In this case scenario you will need the services of a licensed attorney. If remanded and a second CCH is required, Shepler's MD Resolutions is also required to appear.
